Congress Delays, What Else is New
A recent NYT report found that, over the last 3 years, 183 lawmakers traded individual stocks and 93 traded stocks within the industries they sit on committees for. Additionally, Insider reported that 72 members violated the STOCK ACT, a law designed to add transparency to lawmakers' trades. These members either disclosed trades inaccurately, late, or not at all. Insider trading is fairly widespread in Congress, is anything being done?

Fed Raises Rate, Insiders Calmly Wait
Last Wednesday, the Fed raised the federal funds rate by 75 basis points, reaching 3-3.25%, the highest rate since 2008. The Fed’s goal is to limit rising inflation with the goal over the next few years to get inflation down to 2%, the Fed’s inflation target. The differences in regulation for congress and company insiders is quiet startling. Firstly, where members of Congress have 60 days to report their trades company insiders only get 48 hours. Another, huge point is that if insiders profit from buying and selling within 6 months they have to give up all profits, whereas seen above congress gets away with it just fine.

Insider's Strikeout with Short-Swings
What can't insiders get away with? The news is full of cases of insiders making flagrant trades, take Trevor Milton, founder of electric truck startup Nikola (pictured above). Whose stock tanked when it was revealed promotional video of his electric truck 'driving' was just it rollling down a hill with the battery removed to prevent risk of fire. Mr. Milton was later prosecuted by the SEC for false and misleading statements to investors. Clearly lying about your business is prosecutable.

Warren Buffett continued expanding his position in OXY
By far the largest insider trading in August was from Warren Buffett's purchasing of Occidental Petroleum Corp (OXY) for a total of $390,719,420. This is following a flurry of purchases since March 2022, Buffett now holds 188,366,460 shares of OXY or around 20.2% of the company. Additionally, Buffett has warrants to purchase an additional 84 million shares at a price of $59.63, the current price sits around $73. Altogether, that would give Buffett around 30% ownership.
